technical and formal way as consisting in seizing hold of a layer of the fluid and by its movement moving the viscous mass of which it forms a part and gradually accelerating its movement in a path which under the influence of radial and tangential forces it becomes natural for it to assume and follow. We respectfully submit that in a case of such far reaching importance and absolute novelty, where it is assumed that the doctrine of liberality of construction would be preeminently applicable, purely technical objections should not be rigidly adhered to, as the responsibility for adequately protecting the invention by a form of words is a very serious one. We believe the claims to be proper in form and correct in substance. and trust that they may be allowed. In connection with this amendment we desire to offer, in the form of an affidavit of Fritz Lowenstein and clippings from the New York Herald, dated October 15, 1911, The Motor World, dated September 21, 1911, The Scientific American, dated September 30, 1911, some evidences of the remarkable success and promise of the invention and figures showing its value and efficiency. Reconsideration is respectfully asked. Respectfully submitted, Kerr Page Cooper & Hay ward -6[This page retyped from microfilm for better readability - Ed.] 839
