Encan Commissioner of Patents The examiner does not see what right applicant has to assume that a fly-wheel forms a part of the engine shown in the French patent to Jablochkoff of record. Reciprocating engines without fly-wheels were common and well known at the time said French patent, was granted. As an instance, see patent to Wood & Robinson, #78,853, June 9, 1868, "Rock Drills." The expression a piston free to move under the action of steam or a gas under pressure, does not convey any meaning to the examiner whereby applicant's engine could be distinguished from any steam engine, whether used with a fly-wheel or not. Claims 1, 2 and 3 are therefore still held to be met by the above mentioned French patent and are again rejected. Sardbelyſn
