Bulsore JLD. Commissioner of Patents. This application has been considered in view of Affidavit,Exhibit, and amendment filed Dec. 1, 1911. In line 3 of claim 3 it is thought the word "pianed" should be olane; also that in line 5 of claim 6 and line 2 of claim 7 "plain" should be plane. The objection to present claims 6 and 7 (former claims 8 and 9) stated in the third paragraph of Office letter dated Feb. 21, 1911, is withdrawn. It is held, however, that that cbjection applies to which present claim 5, and that all apparatus claims, such as claim 5, define a construction Dixkebqxx common to both cases, should be embodied in one case; otherwise the first case passed to issue will become a reference for the other case.
