1 11 ) ) One of the method claims in suit was as follows: #1. The method of operating electro-magnetic motors having independent energizing circuits, as hersin described, which consists in passing an alternating current through one of the energizing circuits and inducing by such current the current in the other energizing circuit of the motor, as set forth". Both claims were sustained by this court as they had previously been by the courts in nearly every circuit in the country, the syllabus of the court stating in this connection:- "Separate patents for a new and useful process and for a new and useful apparatus to practice it may be sustained although no other apparatus to practice it is known". We respectfully submit that in a case of such far reaching importance and absolute novelty, where it is assumed that the doctrine of liberality & construction would be preeminently applicable, purely technical objections to the form of claims should not be rigidly adhered to, as the responsibility for accurately protecting the invention by a form of words is a very serious one. In connection with this amendment copy of an affidavit of Fritz Lowenstein, the original of which has been filed in connection with Tesla's copending application No. 523832 in Div. 9, together with the following clippings from the press: Engineering News, Oct. 18th, 1911; Scientific American, Sept. 30th, 1911; Motor World, Sept. 21st, 1911; Popular Mechanics, December, 1911 and Hassau Telegraph, Oct. 18th, 1911. It is requested that the above be filed as part of the record as evidence of the remarkable success and promise of the invention, and as proof of its value and efficiency.
