Nikola Tesla, 325 Ruwp 2-260 R/Q DEPARTMENT OF THE INTERIOR UNITED STATES PATENT OFFICE WASHINGTON c/o Kerr, Page, Cooper & Hayward, New York, N.Y. Paper No. 4 All communications respecting this application should give the serial number, date of filing, and title of laveation. Dec. 20, 1911. 5/ OFFICE Please find below a communication from the EXAMINER in charge of your application. #603,049, filed Jan. 17, 1911, for Rotary Engines and Turbines. 10 2011 Biisor. Commissioner of Patents. Response to amendment filed Dec. 1, 1911. As previously indicated, it is not believed that any method is involved in this case. The steam flows through the turbine in a steady stream. There is nothing remotely suggesting a succession of steps or a change in the physical or chemical conditions of the elements involved. If these claims are not simply an expression of the "function of the machine" it is difficult for the examiner to understand what such an expression may mean. With regard to the references it is still held that there would be no invention in omitting the corrugations from the disks in the German patent in view of what is shown in Thrupp. The claims are all rejected. As none of the amendments have material to the points of issue, applicant may consider this rejection final if he so desires. Reynolds P... Ganties. Examiner, Div.18.
