In the matter of the application above named, we now amend by canceling claims 1,2,3,4, and 5, leaving in the case claims 6 to 13 inclusive, which were original claims 15 to 22. not sucIt appearing that attorneys for Mr. Tesla had ceeded in making clear the distinction between the invention claimed and the references cited, and this matter having been further argued orally by the applicant and his attorney before the Examiner, tye assume that the specification and arguments now on file, and which seem to require no changes or additions, are accepted as determinative on this point, and that the apparatus claims now presented will, upon reconsideration, be deemed allowable. We therefore submit the application as amended be reconsidered. for such consideration. By this amendment we have eliminated all of the method claims, but believing that the applicant has invented a true method and is entitled to claims therefor, and that such method constitutes a distinct and substantive invention, we have filed another application as a division of the present case, containing method claims. Our purpose in this is to avoid that delay which a further presentation of such claims in the present application would involve.
